数字经济时代算法价格歧视的监管难题与出路研究 被引量:6

摘要 数字经济时代,平台所依托的算法推荐技术在给平台企业带来竞争优势的同时,也可能损害消费者的权益。平台通过获取消费者个人信息,运用算法定价技术,完成对不同消费者的差异化定价,对消费者施以价格歧视。平台型网络市场的双边性、交易的跨地域性及算法定价技术的隐蔽性,给市场监管部门的执法工作带来了挑战。监管规则滞后、监管手段和工具落后等成为市场监管部门亟须解决的难题。对此,市场监管部门有必要构建“平台-政府”从属监管模式,引入事前监管机制,革新监管规则、细化监管分工,进而建立智慧监管体系。 In the era of digital economy,the algorithm recommendation technology supported by the platform may not only bring competitive advantages to platform enterprises,but also damage the benefits of consumers.The platform obtains consumer personal information and uses algorithmic pricing technology to set differentiated pricing for different consumers and impose price discrimination on consumers.The bilateral nature of the platform-based network market,the cross-regional nature of transactions,and the hiddeness of algorithmic pricing technology have brought challenges to the law enforcement work of market supervision departments.The lag of regulatory rules,regulatory means and tools have become urgent problems that market regulators need to solve urgently.In this regard,it is necessary for the market supervision department to build a“platform-government”subordinate supervision model,introduce a prior supervision mechanism,innovate the supervision rules,refine the division of supervision,and then establish an intelligent supervision system.
