摘要
电子游戏“换皮”行为的出现和泛滥,严重破坏了我国电子游戏行业的秩序,对鼓励创新、保护知识产权产生负面影响。维护原创游戏开发者的著作权,打击“换皮”侵权类不正当竞争行为,是时代赋予我们的任务。本研究基于司法实践与《著作权法》《反不正当竞争法》的具体条文,从电子游戏分类的角度,借鉴“洗稿”侵权认定中常用的“抽象观察法”“接触+实质性相似”等方法,讨论如何认定游戏换皮侵权,为打击国内电子游戏产业“换皮”行为提供新视角、新思路。
The emergence and "prosperity" of the phenomenon of "recombination plagiarizes" in video games has seriously damaged the ecology of China′s video game industry, and has a negative impact on encouraging innovation and protecting intellectual property rights. Safeguarding the copyright of original game creator and cracking down on unfair competition such as "recombination plagiarizes" infringement are the tasks entrusted to us by the era. Based on judicial practice and the specific provision of the Copyright Law, Anti-Unfair Competition Law, from the perspective of classification of video games, reference to the way commonly used in "Manuscript Laundering" infringement — "abstract observation method" and "contact + substantially similar method", to discuss how to judge the infringement of "recombination plagiarizes". Provide a new perspective and a new way of thinking to crack down the phenomenon of "recombination plagiarizes" in domestic video game industry.
