基于审查视角下图形用户界面外观设计专利的比较研究

Comparative Study on the Patent for Graphical User Interface Design Based on Examination Perspective

随着技术的发展与专利制度的不断完善,GUI外观设计专利申请量日益增加。专利审查工作中因图片或照片导致的保护范围不清楚、申请名称和简要说明撰写不规范等问题尤为突出,其根本原因在于针对GUI外观设计的规范性说明少、发展不成熟,导致对其内涵理解存在偏差。基于此,笔者从图形用户界面与产品、变化状态图与参考图、人机交互关系与界面间紧密性三个维度,针对GUI外观设计矛盾焦点,对其内涵进行比较研究,冲破专利申请中的障碍。此外,鉴于外观设计与技术性专利相比较的特殊性,应更加突出图形用户界面设计本身的表达,笔者也期待外观设计专利早日单独立法。

The development of technology and the improvement of the patent system have contributed to the increasing number of applications for Graphical User Interface design patent. The problems of unclear protection scope due to the problem of pictures or photos in the patent examination work, and irregular writing of the application name and brief description are particularly prominent. There are few normative descriptions and immature development of the design, which leads to a deviation in the understanding of its connotation. Based on this, the author conducts a comparative study on the connotation of Graphical User Interface design patent from the three dimensions of graphical user interface and product, change state diagram and reference diagram, human-computer interaction relationship and interface closeness, and breaks through the patent application.. In addition, due to the particularity of design compared with technical patents, the expression of Graphical User Interface design itself should be more prominent. The author also expects design patents to be separately enacted as soon as possible.
