法理概念的三个维度

Three Dimensions of the Concept of Fali

法理是一个多维度、多层次的统合性概念,在不同维度呈现不同的概念面向。在历史学维度,法理表现为对时代精神的统摄和对时代张力的化解;在语言学维度,法理形成以中国古代法理为涵义基底,以日本转译西语为创生进路,以中国近代词语的回引为融合契机,形成了涵养东西方语言文化和精神气质的概念;在法学维度,从本体论、价值论、运行论三层面分析得出:法理是蕴含在现行法律中符合法的价值取向的道理、原则,是评价现行法之为良法的正当性理由,是保证善治实现的运行规律。法理概念的生成、演进、转向与应用,是多种因素的耦合。
