摘要
金融机构在推进普惠金融过程中,面临金额小、无担保、分布广、催收难等产生不良的“分散性风险”,导致金融领域矛盾纠纷多发易发,亟需解决普惠性、适应性和救济性等问题。回应与解决这些问题的切入点在于让金融、第三方专业机构与司法机构在矛盾纠纷的不同发展阶段,依托区块链式的数据分布存储与互信体系,精准、适时地通过包括在线赋强公证在内的多元化方式,推动在线贷前、贷中、贷后的金融机构内控、公共法律服务与诉讼服务一体化管理,在整体上构建“数据金融司法”这一新型的矛盾纠纷源头治理法治范式。该范式超越了社会性或法律性,充分认识到矛盾复杂性、不确定性和非线性,让金融领域的矛盾纠纷源头治理不再是割裂的分而治之,而是以数字化为中介控制变量,以“宽框架”的结构形式和开阔视野,体系化实现多主体、多要素交互的“数字正义”。
In the process of promoting inclusive finance,financial institutions are faced with“scattered risks”such as small amounts,no guarantees,wide distribution,and difficulty in the collection,which results in frequent disputes in the financial sector.Therefore,the issues of inclusiveness,adaptability and the accessibility of relief urgently need to be solved.The starting point for responding to and solving the problems of inclusive finance is to allow finance,third-party professional institutions,and judicial institutions,at different stages of disputes,to rely on the blockchain-based data distribution storage and mutual trust system,accurately and timely through diversified methods including online enforceability notarization,promote the integrated management of online pre-loan,loan,and post-loan financial institutions’internal control,public legal services and litigation services,and on a whole build“data financial justice”,a new paradigm of disputes source governance.This paradigm of the rule of law transcends the social or legal nature,fully recognizes the complexity,uncertainty,and nonlinear characteristics of contradictions,and systematically realizing the multi-subject and multi-element interacted“digital justice”by using digitization as an intermediary control variable,using“wide frame”as structure and using broad vision.
