论监察法律部门的规范建构

On the Normative Construction of the Supervisory Legal Department

以第五次宪法修正案为依托,以《监察法》为规范基础展开,我国创制了全新的独立监察权,构建了一套与世界诸国相异的监察制度,带来了对监察权理解的挑战。从独立监察法律部门的基本维度观察宪法对监察权的创制,有利于系统准确地理解具有中国特色的社会主义监察制度。宪法创制的独立监察权预设了部门监察法的基本定位,监察权的行使也从理论和实践多层面提出了监察法律部门的构建要求。在存在性的实然意义上,部门监察法既非宪法相关法,亦非行政法,更非刑事诉讼法,其应当是一个独立的法律部门,且该法律部门以以《监察法》为核心的监察法体系为规范基础,调整特定的监察法律关系,构成监察权运行的规范场与理论域。

Relying on the fifth amendment to the Constitution and based on the supervision law,China has created a new independent supervisory power and constructed a set of supervision system different from other countries in the world.This uniqueness has brought challenges to the understanding of the supervisory power.Observing the creation of the supervisory power by the constitution from the basic dimension of the independent supervisory legal department is conduc-ive to a systematic and accurate understanding of the socialist supervisory system with Chinese characteristics.The independent supervisory power created by the constitution presupposes the basic positioning of the departmental supervision law,and the exercise of the supervisory power also puts forward the requirements for the construction of the supervision legal department from the aspects of theory and practice.In the practical sense of existence,the departmental super-vision law is neither constitutional law,administrative law,nor criminal procedure law.It should be an independent legal department,and the legal department takes the supervision law system with the supervision law as the core as the normative basis,adjusts the specific supervision legal relationship,and constitutes the normative field and theoretical field of the operation of supervi-sory power.
