论监察权运行的人大监督

On the Supervision of the People’s Congress in the Operation of Supervisory Power

受人大监督是国家监察制度的有机组成部分。强化人大对监察权运行的有效监督,是当前监察体制改革面临的一个关键问题,需要遵循依法监督原则、全面监督原则、人大监督与监察机关依法独立行使监察权相统一原则。监察权运行人大监督的主要机制不限于《监察法》明确规定的“三大”监督机制,还包括监察法规和监察规范性文件的备案审查机制以及监察特定问题调查机制。新时代监察权运行的人大监督制度的完善路径在于修改《监督法》、增补《人大组织法》和《地方人大组织法》,并制定“监察机关专项工作报告办法”“监察法规和监察规范性文件备案审查条例”等监察法规。同时,需要进一步明确人大监督的范围和程序,强化人大监督的问责机制。

Being supervised by the People's Congress is an integral part of the national super-vision system.Strengthening the effective supervision of the People's Congress over the operation of supervisory power is a key issue facing the current supervisory system reform,which need to follow the principle of supervision in accordance with the law,the principle of comprehensive supervision,and the principle of unifying the supervision of the people's congress and the inde-pendent exercise of supervisory powers in accordance with the law.The main mechanism for the supervision of the people's congress is not limited to the"three major"supervision mechanisms clearly stipulated in the"Supervision Law",but also includes the filing and review of supervision regulations and regulatory documents Mechanism,as well as monitoring and investigation mech-anisms for specific issues.At this stage,the improvement path of the people’s congress super-vision system for the operation of supervisory powers lies in the revision of the"Supervision Law",the addition of the"People's Congress Organization Law"and the"Local People's Con-gress Organization Law",and the formulation of the"Special Work Reporting Measures for Supervisory Organs.""Regulations on the Recordation and Review of Supervision Regulations and Regulatory Regulatory Documents"and other supervision regulations.At the same time,it is necessary to further clarify the scope and procedures of NPC supervision and strengthen the accountability mechanism of NPC supervision.
