互联网+大数据时代,社交媒体平台的准入门槛降低,泉涌而出的自媒体影响着社会生活的方方面面。自媒体主体形式多样、类型复杂,其运营中必然涉及对公民个人信息的处理,此种处理不仅关涉网络生态、社会秩序等公共利益,还影响着信息主体的个人信息权益,一旦作出不当处理,会导致重大而不可逆的影响与损失。因此,需遵循《中华人民共和国民法典》《中华人民共和国个人信息保护法》等相关法律规定,规范其信息处理行为。通过分析自媒体处理个人信息的行为属性及其法律地位,探讨相应的处理、例外及禁止规则,研究其违法后的责任承担方式,可以从性质、规则、后果等层面实现对自媒体处理个人信息行为的法律规制,明确对于自媒体个人信息处理行为的类型化规制,从而有利于自媒体在运营中把握处理个人信息的边界,同时兼顾个人信息的利用与保护。

In the era of the internet+big data,the access threshold for social media platforms is lowered,and the we media emerging from the spring affects all aspects of social life.The main body of the we media has various forms and com-plex types,and its operation inevitably involves the processing of citizens’personal information,which not only concerns the public interests such as network ecology and social order,it also affects the personal information rights and interests of the information subject.Once improper treatment is made,it will cause significant and irreversible influence and loss.There-fore,it is necessary to follow relevant laws and regulations such as The Civil Code of the People’s Republic of China,The Personal Information Protection Law of the People’s Republic of China to regulate we media’s information processing be-havior.Through analyzing the nature and legal status of we media’s processing of personal information,the corresponding handling,exception and prohibition rules are discussed,and the way of taking responsibility after breaking the law is stud-ied,we can realize the legal regulation of we media’s processing of personal information from the aspects of nature,rules and consequences,and clarify the type regulation of we media’s processing of personal information.So as to help we media to grasp the boundary of handling personal information in the operation and give consideration to the utilization and protec-tion of personal information in the operation.
