药品犯罪的立法修订评析——以2019年《药品管理法》的修订为切入点

Review of Legislative Amendments to Drug Crimes——Taking the 2019 Amendment to the Drug Administration Law as an Entry Point

为与2019年《药品管理法》的修订相衔接,《刑法修正案(十一)》对药品犯罪的规定作出了相应的修改。通过《刑法修正案(十一)》的修订,我国药品犯罪的行为规制环节向前拓展至药品的研发、申报、审批过程,向后延伸至药品的使用环节,对药品管理秩序的专门保护得以凸显。由此,我国药品犯罪的刑法规制范围得以扩大。在《刑法》对生命、健康法益与药品管理秩序的分立化保护的过程中,就修订后的药品犯罪的规定而言,仍然存在着生命、健康法益与药品管理秩序法益分立不彻底、相互杂糅和罪名体系位置不当的现象。为此,应当删去妨害药品管理罪的具体危险犯形态的规定,将该罪纳入“妨害社会管理秩序罪”一章;将生产、销售、提供假药罪和生产、销售、提供劣药罪纳入“危害公共安全罪”一章。

In order to dovetail with amendment of the Drug Administration Law in 2019,the Amendment(Ⅺ) to the Criminal Law has made corresponding changes to the provisions on drug crimes.Through the revision of the Amendment(Ⅺ) to the Criminal Law,the conduct regulation link of drug crimes in China is extended forward to the research and development,declaration and approval process of drugs,and backward to the use of drugs,and the special protection for the order of drug management is highlighted.As a result,the scope of the criminal law for drug crimes in China has been expanded.In the process of discrete protection of the legal interests of life and health and the order of drug management in the Criminal Law,there are still incomplete separation of the legal interests of life and health and the legal interests of the order of drug management,and inappropriate location of crime system as far as the provisions of the revised drug crimes are concerned.To this end,the provisions on the specific form of dangerous crime of obstructing drug administration should be deleted,and the crime should be incorporated into the chapter of "crimes against the order of social administration";the crimes of producing,selling and supplying counterfeit medicines and producing,selling and supplying substandard medicines should be incorporated into the chapter of "crimes against public security".
