治安调解作为我国多元化纠纷解决机制的重要一环,发挥着一定的积极作用,但仍有可以优化的空间。优化我国治安调解是全面推进依法治国建设、推动国家治理现代化进程以及促进社会和谐稳定的应有之义和客观要求。优化我国治安调解的主要缘由是治安调解的适用案件具有一定模糊性,当下的矛盾纠纷解决机制没有形成合力,公民有困难时对公安机关及人民警察的过度依赖。而从立法角度出发解决治安调解适用条件的模糊问题、健全多种调解联动机制进而提高合力、加强与治安调解相关的法治宣传教育是优化我国治安调解的主要路径。

As an important part of China’s diversified dispute resolution mechanism,public security mediation plays a certain positive role,but there is still room for optimization.The optimization of public security mediation in China is a proper and objective requirement to comprehensively promote the construction of the rule of law,promote the modernization process of national governance and promote social harmony and stability.The main reasons for optimizing public security mediation in China are as follows:the ambiguity of the applicable cases of public security mediation,the lack of synergy in the current dispute resolution mechanism,and the over-reliance on public security organs and their people’s police when citizens have difficulties.The main ways to optimize public security mediation in China are as follows:to solve the ambiguity of the applicable conditions of public security mediation from the perspective of legislation,to improve the joint mechanism of various kinds of mediation so as to enhance the synergy,and to strengthen the publicity and education on the rule of law related to public security mediation.
