司法的象征生产与认同想象

Symbolic Production and Identity Imagination of Justice

作为利益再分配机制的司法在处理零和博弈的各方诉求时,显然不能满足于以“结果好,一切都好”的实用主义策略来换取有限的个体化利益认同,更要上升到象征生产层面唤起最广泛的集体认同想象。法谚有云:正义必须以看得见的方式实现。“看得见的正义”作为需要依赖想象进行意义诠释的价值范畴,无论是其表意过程还是认知方式,都需要借用仪式化的符号载体进行想象力的捕捉。在不同的社会政治文化背景下,想象正义的仪式化策略也不可避免会在广泛征用传统合法性的路径依赖中产生分化。在高度分化的现代社会,从回应社会解纷需求的角度来看,司法作为一种社会公共产品,其在供给策略上也应该对接需求端的社会分化现实来营造仪式感。

When dealing with the demands of all parties in the zero sum game,justice,as a benefit redistribution mechanism,obviously can not be achieved through the pragmatism strategy that“If the result is good,then everything is good”that in exchange for limited individual interest recognition,but shall rise to the symbolic production level to airse the broadest collective recognition and imagination.As what the proverb goes:justice must be realized in a visible way.“Visible justice”needs to rely on imagination for interpretation,and whether its ideographic process or cognitive mode,needs to use the ritual symbol carrier to capture imagination.Under different social,political and cultural backgrounds,the ritual strategy of imaginative justice will inevitably differentiate in the path dependence of widely expropriating traditional legitimacy.In a highly polarized society society,from the perspective of responding to the needs of resolving social disputes,justice,as a social public product,its supply strategy should also be in line with the reality of social differentiation on the demand side to create a sense of ritual.
