民法典时代的教学与研究初探

伴随着《民法典》的颁行,民法典时代已经来临。《民法典》颁布以后,要尽快构建中国民法理论体系和话语体系,为此需要在继承中彰显民族性,在内容上永葆实践性,在发展中彰显时代性,在借鉴中彰显包容性。在进入民法典时代后,需要树立法典化的思维方式。调整研究重心,服务《民法典》实施和民商事法律制度的完善,同时应该以《民法典》为基准,推进课程改革和教材体系建设,将《民法典》所体现的核心价值观贯穿于民法教学之中,注重案例教学,做到学以致用。需要掌握民法研习的各种方法,以准确把握《民法典》的新理念、新制度,并将其运用于实践,解决实际问题。

With the promulgation of the“Civil Code”,the era of the Civil Code has arrived.It drives to build a theoretical system and discourse system of Chinese civil law as soon as possible.Therefore,it is necessary to demonstrate the nationality in the inheritance,maintain practicality in content,show the characteristics of the times in the development,and reflect the inclusiveness in reference.The era of Civil Code,calls for a codified way of thinking.It requests to adjust research to serve the implementation of the Civil Code and the improvement of the civil and commercial legal system.At the same time,the Civil Code should be used as a benchmark to promote curriculum reform and teaching material system construction,and the core values embodied in the Civil Code should be incorporated into the teaching of civil law.with focus on the case studies and their application.Finally,it is necessary to master various methods of civil law study,such as system analysis methods,in order to accurately grasp the new concepts and new systems of the Civil Code,and apply them to the solution of practical problems.
