民法典实施一周年观察

Observation on the First Anniversary of the Implementation of the Civil Code

民法典颁布后,最高人民法院为贯彻实施民法典做了大量司法解释和指导性案例的清理以及制定工作。面对民法典实施过程中出现的新问题、新挑战,司法解释与指导性案例需要与时俱进,但不应当过度积极地创设新规则,以免削弱民法典及其配套规范的体系效应。民法典施行以来,法院在民事审判中进一步体现社会主义核心价值观,并在一定程度上矫正过去对于意思自治的过分强调。未来民法学研究应当保持与司法解释和审判实践之间的强联动性,继续推动解释论研究向纵深、细微处发展,不局限于对个别制度的过度讨论而应当全面开花,同时注意与刑法、行政法、个人信息保护法等相关法律制度的衔接,为交叉性问题及案件的研究提供建设性方案。

After the promulgation of the Civil Code,the Supreme People’s court has done a lot of clean-up and formulation of judicial interpretations and guiding cases for the implementation of the Civil Code.Facing the new problems and challenges in the implementation of the Civil Code,judicial interpretations and guiding cases need to keep pace with the times,but should not be overly aggressive in creating new rules,in order to avoid weakening the system effect of the Civil Code and its supporting norms.Since the implementation of the Civil Code,the court has further embodied the core values of socialism in the civil trial,and corrected the excessive emphasis on autonomy of will in the past to a certain extent.In the future,the study of civil law should maintain a strong linkage with judicial interpretations and judicial practice,continue to promote the development of interpretative research in depth and details,not be limited to the excessive discussion of specific systems but blossom in an all-round way,pay attention to the connection with relevant legal systems such as Criminal Law,Administrative Law and Personal Information Protection Law,and provide constructive solutions for the research of problems and cases in cross fields.
