家事调解机制在离婚冷静期中的切入——以《民法典》第1079条为中心

《民法典》第1077条设置了离婚冷静期制度,第1079条明确了调解机制,但是对于离婚冷静期内能否适用以及如何适用调解并没有释明。离婚冷静期制度在实施过程中缺乏第三方沟通机制,家事调解正是冷静期内夫妻间沟通的重要载体。从我国当前实际情况来看,家事调解机制与离婚冷静期制度具有天然的契合性,二者在理念和目的上有异曲同工之妙,通过引入家事调解机制,可以弥补离婚冷静期制度存在的不足,有利于离婚冷静期的更好运作。在将家事调解引入到离婚冷静期制度的过程中,要坚持实体与程序双重保障,明晰家事调解的实体规范和具体制度,完善和细化调解程序规则和调解流程,同时对调解队伍进行专业化、职业化、现代化整合。
