基于区块链技术的NFT艺术品著作权问题研究

Research on the Copyright of NFT Artworks Based on Blockchain Technology

NFT艺术品作为依托区块链技术的新兴产物,它与作品著作权息息相关。如何理解NFT艺术品在产生、发行、流转、灭失生命周期中著作权的授权、归属、权利划分,以及对著作权行使的限制,这对NFT艺术品市场的规范尤为重要。文章首先介绍NFT技术原理与NFT艺术品,之后以NFT的全生命周期阶段来揭示出NFT最重要的基础性权利——著作权的内涵及外延与其面临的风险。在此基础上,阐述NFT艺术品目前的监管现状,最后对NFT艺术品著作权权益的保护提出建议。

As a new product of blockchain technology,NFT artworks are closely related to the copyright of works.How to understand the authorization,ownership,division of rights and restrictions on the exercise of copyright in the life cycle of NFT artworks,such as production,distribution,circulation and loss,is particularly important for the regulation of NFT artwork market.This paper first introduces the principle of NFT technology and NFT artworks,and then reveals the connotation and extension of copyright,the most important basic right of NFT,and the problems and risks it faces,in the order of stages in the whole life cycle of NFT.On this basis,this paper expounds the current regulatory status of NFT artworks,and finally puts forward some suggestions on the protection of copyright rights and interests of NFT artworks.
