行贿人“黑名单”制度的功能定位与实现

Function Orientation and Realization of“Blacklist”System of Briber

一般认为行贿人“黑名单”制度有诚信建设、信息公开、惩处威慑功能,但这些观点在逻辑性、公平性和合法性方面都存在不足。理论研究上的模糊性往往造成对现实问题认识的迷乱和不足。在制度功能实现的过程中,人们担心行贿人“黑名单”作用十分有限、个人信息会被滥用、信用功能演变成审批功能、惩戒功能易走偏变异。笔者认为,促进清廉建设、维护公共利益、强化道德规制是行贿人“黑名单”制度应有的三大功能,但要将这些功能发挥出来,需要增加行贿人“黑名单”的功能模块、扩大信息内容和运用空间、提高行贿人“黑名单”使用效率和质量、防止行贿人信息资料被滥用。

It is generally believed that the system of“Blacklist”of briber has the functions of credit construction,information publicity and punishment deterrence,but these viewpoints have their shortcomings in logic,fairness and legitimacy.The fuzziness in theoretical research often leads to confusion and deficiency in the understanding of practical problems.In the process of realizing the function of the system,people worry that the function of the“Blacklist”of briber is very limited,the personal information will be abused,the function of credit will become the function of examination and approval,and the function of punishment will go astray.To promote the construction of clean-governance,safeguard the public interest and strengthen the moral regulation are the three functions of the system of“Blacklist”of briber,and it is necessary to increase the function module of“Blacklist”of briber,enlarge the information content and application space,improve the efficiency and quality of“Blacklist”of briber,and prevent the information of briber from being abused.
