The Effect and Optimization Path of Hainan Village Legal Counsel System under The Background of Free Trade Port Construction

村居法律顾问工作被称为畅通基本法律服务的“最后一公里”,海南全面推进村居法律顾问制度,实现了全省224个乡镇3229个行政村(居)法律顾问全覆盖,并取得制度建设逐步完善、服务形式有效覆盖、阶段性效果显著的成效。在海南自贸港建设的大形势下,村居法律顾问制度对于营造良好营商环境、实现法治城乡联动具有重要的现实意义。但这一制度在海南的实践仍存在区域供给失衡、服务需求与反馈机制衔接不畅、服务体系精准度欠缺、政府期待值与村民参与度存在差异等运行困境,需要从整合村居法律顾问资源配置、畅通村居法律服务需求与反馈、探索民族地区的精准法律服务体系、增强社会对村居法律顾问工作的参与认同等方面进行优化。

Village legal counsel is called the "last mile" of unblocking basic legal services. So far,Hainan has comprehensively promoted the village legal counsel system which has achieved full coverage of legal counsel in 3,229administrative villages in 224 townships.What’s more,the system construction is gradually improved and the service forms are effectively covered.So we can see that the stage effect is remarkable. With the construction of Hainan Free Trade Port, the village legal adviser system actually has practical significance for creating a good business environment and realizing the linkage between urban and rural areas under the rule of law. Obviously,nothing is perfect. The practice of this system in Hainan still has operational difficulties such as regional supply imbalance, poor connection between service demand and feedback mechanism and lacking of accuracy in the service system. Well,we should also take the differences between the government’s expectation and villagers’ participation into consideration. It is necessary for Hainan government to integrate village legal counsel resources,optimize the configuration, smooth the needs and feedback of legal services for village residents.Moreover,exploring the precise legal service system in ethnic areas and strengthening the community’s participation and recognition of the work of village legal consultants are still on the way.
