设区的市科学立法的实证分析——基于江西省设区的市人大立法的考察

Empirical Analysis of the Scientific Legislation of the City with Districts7——Based on the Investigation of the Legislation of the People’s Congress in City with Districts of Jiangxi

科学立法是我国立法的一项基本原则。立法技术的专业性、立法程序的完备性、规则的一致性以及规则内容的可行性构成了广义的立法科学性标准。通过对江西省设区的市人大及常委会立法情况的分析发现,我国地方立法工作虽然有了重大进展,但现实中面临着科学立法理念缺乏、立法程序不完备、立法内容不科学等阻碍科学立法的问题。解决问题的关键是以科学性理论为基础,以完善程序为基点,用科学论证和民主协商相结合的方法,聚焦设区的市的特殊问题节制性立法。

Scientific legislation is a basic principle of China’s legislation.The professionalism of legislative technology,the completeness of legislative procedures,the consistency of rules,and the feasibility of the content of rules constitute the broad scientific standard of legislation.Through the analysis of the legislative situation of the People’s Congress and the standing committees of cities with districts in Jiangxi province,it is found that while the local legislative work in China has made great progress,in reality,it is faced with the lack of scientific legislative ideas,incomplete legislative procedures,and unscientific legislative content.The key to solving the problem is to use the scientific theory as the basis,improve the procedures as the focus,and combines the scientific proof and democratic consultation to focus on the special problems of city with district.
