Legislation and Connection of Administrative and Criminal Systems on Prescription Drug Online Sale

随着“互联网+”技术的不断发展,加之网络销售药品政策的放开,医药行业的销售模式也随之变化。处方药网络销售由传统线下销售转换到线上销售,依托医药电商平台发展成一种新兴模式,人们购买药品的种类也逐步由非处方药向处方药拓展。在数字化转型的风口下,“互联网+”模式放开销售处方药已势在必行,但与之相匹配的法律法规尚未规制完备,监管手段存在部分缺失,实际网售流程中也存在审核、广告、处罚等诸多隐患。基于以上问题,通过论述“互联网+”模式下处方药销售模式分析潜藏隐患与法律风险,从纵向多重法律保障与横向搭建运营体系出发,意在完善“互联网+”模式处方药销售程序,建立完备的医药电商平台体系。

With the continuous development of“Internet+”technology and the liberalization of online drug sales policy,the sales model of the pharmaceutical industry has also changed.Online sales of prescription drugs is an emerging model that has changed from traditional offline sales to online sales and relies on the development of pharmaceutical e-commerce platform.The types of drugs purchased by people have gradually expanded from over-the-counter drugs to prescription drugs.Under the circumstances of digital transformation,the“Internet+”model liberalizes the sale of prescription drugs,while the laws and regulations matching the“Internet+”model have not been fully regulated.There are some deficiencies in regulation,hidden dangers such as review,advertising,and punishment in the actual online sale process.Based on the above problems,the authors analyze the hidden dangers and legal risks of the prescription drug sales mode under the“Internet+”mode,and aim to improve the prescription drug sales procedure under the“Internet+”mode and establish a complete pharmaceutical e-commerce platform system from two aspects of vertical multiple legal guarantees and horizontal operation system.
