依法保护农民权益是党和国家三农工作的出发点和价值归宿。依法保护农民权益的前提是党、人大和政府等主体对农民民生需求进行全面识别,依法保护农民权益的关键是政治、法律和行政三个表达维度对农民民生需求进行准确表达。当前中国农民权益法律保护陷入保守化、碎片化和非均衡化困境。在乡村振兴背景下,应当以农民“美好生活需求”为目标,拓展农民权益法律保障范围,确立农民“乡村振兴主体”的法律地位,激发主体性,同时优化保护路径,实现政治、法律与行政三个表达维度的系统整合。
