地方立法与民间规范融合的可能及其路径——以治理能力现代化为视角

The Possibility and Path of the Integration of Local Legislation and Civil Norms:From the Perspective of Modernization of Governance Capacity

地方立法与民间规范各自均具有治理体系和治理能力的构成元素,但又存在程度上的差异。地方立法与民间规范在立法目的、立法前提、立法空间、立法考量上具有相似性,这也使二者融合具有可能。地方立法与民间规范在本质属性、秩序位阶、实施效果等方面各有侧重与差异,但并不会产生两者相容的障碍。贯彻落实习近平法治思想,加强地方立法与民间规范的融合,应通过“规范多元化”的引入来补充“国家法”的不足,构建地方立法前民间规范的调研机制,发挥民间规范对地方立法的补充作用,注重地方立法对民间规范的吸收与规制。

Both local legislation and civil norms have the constituent elements of governance system and governance capacity,but there are differences in degree.Local legislation and civil norms bear similarities in legislation purpose,legislation premise,legislation space and legislation consideration,which also makes it possible to integrate the two.Local legislation and civil norms have their own emphasis and differences in terms of essential attributes,orderly status and implementation effects,but these differences do not create obstacles to their compatibility.To implement Xi Jinping’s thought on the rule of law and strengthen the integration of local legislation and civil norms,we should supplement the"national law"through the introduction of"norm diversification",build a research mechanism for civil norms before local legislation,give full play to the influence of civil norms on local legislation,and give due emphasis to the absorption and regulation of local legislation on civil norms.
