In the era of artificial intelligence,as the cornerstone of blockchain transactions,smart contracts not only affect the formation of a new contractual order but also have a profound impact on the rules of group autonomy driven by technology.Systematic interpretation of smart contracts is an important task for civil and commercial law to coordinate private relations in a smart society.Each smart contract is an self-governance framework integrating the contract text,contract performance and group autonomy rather than a certain kind of contract in the traditional contract law.Under the concept of respecting the scientific and technological progress,the group law is introduced as an analytical tool to systematically analyze the internal structure,reliance basis and group autonomy of smart contracts,demonstrate the group voting mechanism of smart contract members in the context of private law,and prove the compliance of smart contract with the concept of private law.On the basis of the above,different types of smart contracts are divided to demonstrate the functional differences of their different structure,so as to clarify the rights and obligations of the members of smart contracts,and establish the dispute settlement path and the legal liabilities of the parties.Furthermore,by coordinating the relationship between individual freedom and group freedom,we can promote the common development of scientific and technological progress and legal progress,and finally consolidate the rule of law foundation of fairness and justice in a smart society.
