摘要
通过分析某企业安排未经岗前职业健康检查的劳动者从事接触职业病危害的作业案子,讨论其接受产生职业病危害的作业转移的合法性,探讨办案过程中关键点的把控、主体认定、证据收集、法律适用等问题,并从职业病危害的作业转移缺乏界定标准等方面提出建议。
By analyzing the case of an enterprise that arranges laborers exposed to occupational disease hazards without a pre-job Occupational Health Examination to engage in the operation,to discuss the legality of accepting the transfer of the operation that produces occupational disease hazards,and the control of these key points in the process of handling the case,including,subject identification,evidence collection,law application,and other issues,to put forward suggestions from the aspects of the lack of definition standard for occupational hazard transfer.
