中国法治赓续于中华优秀传统法治文化,植根于中国法治的具体实践,形成了具有中国底色的法治系谱。《管子》是中国法治的早期理论渊源,体现了法家先驱管仲及稷下学派思想家对古典法治问题的思考,是解码中国法治系谱的重要文献。《管子》提出的“富民利农”理论具有显著的朴素唯物主义特征,为中国古典法治思想的展开提供了理论支撑。“德法共治”“国之四维”“以人为本”等古典法治思想,是新时代中国特色社会主义法治理论可资借鉴的法治本土资源。

The rule of law in China is rooted in the concrete practice of the rule of law in China,and has formed a pedigree of the rule of law with Chinese roots.Guanzi is the early theoretical source of the rule of law in China.It reflects the thinking of the pioneers of legalism-Guan Zhong and the thinkers of Jixia School on the classical rule of law,and is an important document to decode the pedigree of the rule of law in China.The theory of“enriching the people and benefiting the peasants”put forward by Guan Zi has obvious characteristics of simple materialism,which provides theoretical support for the development of classical thought of rule of law.Classical ideas of rule of law,such as“co-governance of morality and law”,“four dimensions of the country”and“people-oriented”,are the local resources of rule of law for reference in the socialist rule of law theory with Chinese characteristics in the new era.
