摘要
设置宅基地使用权的初衷在于保障农民的生存条件,但在城市化进程的逐步推进下,城乡二元结构被打破,随之而来的是大量农村人口向城镇转移,城市建设用地急剧增长。但农村地区的宅基地使用权流转还处在限制状态,造成大量土地资源闲置,不仅阻碍了土地资源重大战略作用的发挥,还限制了城市化进程,不利于经济增长。部分农民为处理闲置宅基地,私下进行交易,不仅损害了农民自身利益,也损害了国家和集体的利益。为使乡村宅基地使用权流转和城镇化进程相适应,减少流转过程中的违规违法行为,规范乡村治理,有必要从现行法律和相关管理方面着手,对其中存在的问题和完善路径进行探究。
The original intention of setting the right to use homestead is to protect the living conditions of farmers.However,with the gradual advancement of urbanization,the urban-rural dual structure has been broken,followed by the transfer of a large number of rural population to cities and towns,and the rapid growth of urban construction land.However,the circulation of homestead use right in rural areas is still limited,resulting in a large number of idle land resources,which not only hinders the exertion of the major strategic role of land resources,but also limits the process of urbanization and is not conducive to economic growth.Affected by this,in order to deal with idle homestead,some farmers privately built a chaotic underground trading market for the transfer of homestead use right,which not only damaged the interests of farmers,but also the interests of the state and the collective.In order to adapt the circulation of rural homestead use right to the process of urbanization,reduce violations in the process of circulation and standardize rural governance,it is necessary to explore the existing problems and improvement paths from the aspects of current laws and relevant management.
