仲裁裁决撤销制度的实证分析研究

An Empirical Analysis and Research on the Revocation System of Arbitral Award

仲裁裁决的执行是仲裁机构的生命线,对裁决的频繁撤销将会影响仲裁行业的公信力。通过对法院审理撤销仲裁裁决案件所作的79份裁定书的实证研究表明,导致裁决撤销的根本原因是国内撤裁事由与国际不接轨、司法实践认定撤销事由不符合法定条件、部分仲裁员的审判能力不强以及仲裁机构缺乏监管。为避免裁决被撤销,提升仲裁行业的公信力,立法规定应与国际接轨,统一司法实践认定标准,提高仲裁员的审判能力,加强仲裁机构的内外监管。

The enforcement of arbitral award is the lifeline of arbitration institutions,so the frequent revocation of arbitral award will affect the credibility of the arbitration industry.The causes are that the domestic reasons for revoking the award are not in line with the international standards,the judicial practice finds that the reasons for revoking the award do not meet the legal conditions,the judicial ability of the arbitrators is not strong,and the arbitration institutions are lack of supervision.In order to avoid the revocation of the award and enhance the credibility of the arbitration industry,the legislation should be in line with international standards,unify the recognition standards of judicial practice,improve the trial ability of arbitrators,and strengthen the internal and external supervision of arbitration institutions.
