论中华法系的创新发展

On the Innovation and Development of Chinese Legal System

法系的构成一般都有三个基本要素,即母国、成员国、联系母国与成员国的通道。中华法系也是如此。中华法系的创新发展就是要借鉴中华法系深厚的法律文化,通过创新发展来建设一个新的中华法系。中华法系的创新发展要求中国、成员国、联系中国与成员国的通道都要创新发展。中华法系的创新发展有个过程,也需要时间。当前,不能等待观望而要积极做好前期准备工作,尤其要重视进行必要的研究与教学,以便提供智力支持与人才培养。法学、法律人具有不可推卸的责任,需要作出努力,为中华法系的创新发展添砖加瓦。

The home country,the member countries and channel connecting them are the three basic elements to compose a legal system,so does the Chinese legal system.The innovation and development of Chinese legal system lies in its profound legal culture,and a new Chinese legal system cannot be established without innovation and continuous development.Meanwhile,it also calls for synchronized innovative development of China,member countries and the channel.It takes time for establishing such a new one.Now there should be no more waiting but take ini-.tiative to make preparations,especilly attach importance to carry out necessary research and teaching to provide intellectual support and talent training.To this end,it is the compelling obligations of the discipline of law and law practitioners to make more efforts in the innovation and development of the Chinese legal system.
