论法律预期目的及其规范预设

On the Goal of Legal Expectation and Its Normative Presupposition

法律是人们交往行为的预期机制。在法律预期中,最重要的是其总体性的、宏观性的预期目的。这种预期与人们赋予法律中的价值相关。如果法律价值主要表现为秩序、自由和正义的话,那么其预期机制的规范预设则分别表现为义务规范、权利规范和权力/责任(消极义务)规范,三者构成法律预期目的保障,即义务规范主要为秩序预期所预设,权利规范主要为自由预期所预设,而权力/责任(消极义务)主要为正义预期所预设。

Law is an expectation mechanism for human interaction and communication.Of the legal expectations,the most important one is the general expected goal,which is concerned with the values that human give to law.If the legal values are often manifested in a dialectical structure that mainly comprises order,freedom and justice,the normative presupposition for this expectation mechanism can be categories into the norms on duties,on rights and power/responsibility(negative duties),which can constitute the dialectical structure of positive,negative and combinational values,i.e.the norms on duties are mainly supposed to make expectations on order,the norms on rights to make expectations on freedom,and the norms on power/responsibility to make expectations on justice.
