国内法律法规视角下的个人隐私保护研究

Research on Personal Privacy Protection from the Perspective of Domestic Laws and Regulations

[目的/意义]通过梳理我国现行71部个人隐私法律法规相关内容,为完善个人隐私保护法律法规提供参考。[方法/过程]采用文本分析法,归纳我国个人隐私保护法律法规的整体特征与保护内容,提出相应优化策略。[结果/结论]我国现行的71部个人隐私法律法规已从信息处理、风险评估、联合监管、委托合作、安全教育、责任处罚、应急预案7个维度提供了个人隐私保护路径,但仍存在一定的缺陷。为充分保护个人隐私提出如下4种优化策略:建立健全个人隐私保护的法律法规体系、妥善实施个人隐私保护与个人信息保护、完善个人隐私保护技术规则、详细明确侵权行为与信息公开原则。

[Purpose/significance]By sorting out 71 current personal privacy laws and regulations in China,this paper provides references for improving personal privacy protection.[Method/process]This paper uses text analysis method to summarize the overall characteristics and protection content of Chinese personal privacy protection laws and regulations,and propose corresponding optimization strategies.[Result/conclusion]The current laws and regulations of personal privacy protection paths in China from the seven dimensions,including information processing,risk assessment,joint supervision,entrusted cooperation,safety education,liability punishment,emergency plan,points out the defects of personal privacy protection in current laws and regulations in China,and puts forward four optimization strategies:to establish and improve the legal and regulatory system for personal privacy protection,to properly implement personal privacy protection and personal information protection,to improve the technical rules of personal privacy protection,to clarify the torts and the principles of information disclosure.
