法律视域下推进数字人民币发展的现实困境与优化路径

Realistic Predicament and Optimized Path of Promoting the Development of E-CNY from the Perspective of Law

从法律视域下审视,我国数字人民币具有法定货币的法律性质。尽管如此,数字人民币仍具有其独立的特征,必须厘清数字人民币与实体货币和其他非法定数字货币之间的区别。当前,在数字人民币应用进程中,存在数字人民币物权与流转之规定较模糊、数字人民币在刑事司法领域面临适用难题以及数字人民币法律关系主体的权利和义务设定不明晰等现实困境。为此,必须明确数字人民币的法律地位,进一步完善数字人民币的立法,正确处理数字人民币试点中个人信息保护、明确其监管责任以及制定严谨的机构准入标准,进一步优化数字人民币发展。

From the perspective of law, e-CNY has the forensic nature of legal tender in China.However, e-CNY has its own independent characteristics. It is necessary to clarify the differences between digital RMB, physical currency and other non-legal digital currencies. At present, in the process of promoting the implementation of digital RMB, there are still some problems, such as vague regulations on the real right and circulation of e-CNY, difficulties in the application of e-CNY in criminal justice, and unclear rights and obligations of the subject of the legal relationship of e-CNY.Therefore,it is necessary to clarify the legal status of e-CNY, further improve the legislation of e-CNY,and correctly deal with the personal information protection, clarifying its regulatory responsibilities and establishing strict institutional access standards, further optimize the development of e-CNY.
