元宇宙治理视域下虚拟社会的潜在风险及法律规制

Potential Risks and Legal Regulations of Virtual Society from the Perspective of Metaverse Governance

随着区块链、人工智能、AR技术的日益成熟,人类的宇宙观向数字宇宙转变,“元宇宙”也成为学界研究的热点。作为互联网新一代的发展趋势,虚拟社会兼具沉浸式体验、交互性、去中心化等特性。然而,虚拟主体的多样化、数字资产的所有权和交易安全问题、元宇宙信息过载等问题衍生出一系列法律风险,主体多重身份引发的犯罪问题、数字资产交易的缺乏保障、信息过载导致环境的高度自治等潜在风险对虚拟社会的基础秩序提出挑战,亟待法律界对此进行回应。为了确保虚拟社会的有序发展,必须在风险范围内制定切实有效的规则,以技术和法律双重规制为原则,实现虚拟社会的有效治理。

With the increasing maturity of blockchain,artificial intelligence,and AR technologies,the human cosmology has shifted to the digital universe,and the “metaverse”has also become a hot spot in academic research. Conforming to the development trend of the new generation of Internet,virtual society has the characteristics of immersive experience,interactivity and decentralization. However,the diversification of virtual entities,the ownership and transaction security of digital assets,and information overload in the metaverse have resulted in a series of legal risks. The multiple identities of the entities caused the crime problem,the lack of guarantee of digital asset transactions,and the information overload caused environmental damage. Potential risks such as a high degree of autonomy pose challenges to the basic order of virtual reality society,and the legal community urgently needs to respond to this. In order to ensure the orderly development of the virtual reality society,it is necessary to formulate practical and effective rules within the scope of risk,and to realize the effective governance of the virtual reality society based on the principle of dual regulation of technology and law.
