“双碳”目标下政府节能管理和节能执法关系研究

Research on Relationship between Government Energy Conservation Management and Energy Conservation Law Enforcement under ’Double Carbon’ Goal

碳达峰碳中和与政府能源工作密切相关,正确认识和有效协调节能管理与节能执法之间的关系,对我国碳达峰碳中和目标的实现具有重大的现实意义。在立足碳达峰碳中和对政府能源工作新要求的基础上,比照分析节能管理和节能执法间的联系与区别,并就两者在碳达峰碳中和目标下的关系协调提出相应建议,明确要想在碳达峰碳中和的目标导向下,充分行使节能管理与节能执法,有效协调两者之间的关系,就应当以法治建设为保障,坚持依法行政;以公共管理为依托,坚持效能优先;以社会公众为纽带,坚持互联互动。

Carbon Peaking and Carbon Neutrality is closely related to the government’s energy work.Correctly understanding and effectively coordinating the relationship between energy conservation management and energy conservation law enforcement is of great practical significance to the realization of my country’s carbon peaking and carbon neutrality goals. Based on the new requirements for government energy work on the basis of carbon peaking and carbon neutrality, this paper comparatively analyzes the relationship and difference between energy conservation management and energy conservation law enforcement and proposes a coordinated relationship between the above two under the goal of carbon peaking and carbon neutrality. Corresponding suggestions, it is clear that in order to fully exercise energy conservation management and energy conservation law enforcement under the goal of carbon peaking and carbon neutrality and effectively coordinate the relationship between the above two, we should take the construction of the law rule as the guarantee and insist on administration according to law;Rely on public management, adhere to the priority of efficiency;take the public as a link,adhere to the interconnection and interaction.
