利用网络性侵害未成年人的检察监督保护

通过检索S市三年以来利用网络性侵害未成年人犯罪的一审裁判文书,结合S市S区检察机关办案实践,发现以网络为媒介或者工具性侵害未成年人案件呈增长趋势,线上与线下相结合成为该类犯罪的主要行为模式。究其原因,主要为未成年人易受网络影响、网络平台自身管理不严、主体监护责任不到位等。结合案件特点和检察机关工作职能,应当从强化打击利用网络性侵害未成年犯罪力度、加强未成年人综合素养、营造良好的网络环境等方面切实发挥检察机关检察监督作用,落实对未成年人的特殊保护。

By retrieving the first-instance judgment documents of the crime of sexual abuse of minors through the Internet in the past three years in S City,combined with the case-handling practice of the S District procuratorial organs in S City,it is found that the cases of sexual abuse of minors using the Internet as a medium or tool are increasing.The combination of online and offline has become the main mode of behavior of this type of crime.The main reasons are that minors are easily affected by the Internet,the network platform itself is not strictly managed,and the main guardian responsibility is not in place.In light of the characteristics of the case and the functions of the procuratorial organs,the procuratorial organs’role in procuratorial supervision should be effectively brought into play in terms of intensifying efforts to crack down on crimes that use the Internet to sexually assault minors,strengthening the comprehensive quality of minors and creating a favorable online environment to implement the special protection of minors.
