近年来,债式虚假诉讼案较为多发。债式虚假诉讼成因多、属性多、表现多,发现难、调查难、追责难、治理难,严重扰乱了司法秩序,损害了社会诚信。在立足实际的基础上,系统研究债式虚假诉讼案发机制,剖析实务属性、总结成案类型、探究案发原因,融合设计循环式调查核实权智能化前置机制,可以为优化办案机制,帮助基层检察机关高质量履职,提升债式虚假诉讼治理水平提供合理进路。

In recent years,there have been many cases of debt-based false litigation.Debt-based false litigations have many causes,attributes and manifestations,and are difficult to discover,investigate,hold accountable and manage,which seriously disrupts judicial order and damages social integrity.On the basis of reality,systematically study the mechanism of debt-based false litigation,analyze the practical attributes,summarize the types of cases,explore the reasons for the incidents and integrate the design of an intelligent pre-process of circular investigation and verification rights,which can help optimize the case-handling mechanism,help the grassroots procuratorial organs perform their duties with high quality and provide a reasonable way to improve the governance of debt-based false litigation.
