摘要
基于中央提出的“被征地农民原有生活不降低,长远生计有保障”的政策目标和新《土地管理法》第48条的规定,理论上探索市场化征地补偿标准,不仅有利于体现被征收财产的完全、真实价值,保障被征地农民的财产性权利,而且还有利于实现公益与私益的平衡。本文认为,关注土地的最高且最佳用途,强调补偿的等价公平,有助于让被征地农民分享土地增值收益。土地使用权交易市场的开放以及国有土地上房屋征收补偿制度的改革,为农村集体土地征收的公平市场价值补偿提供了制度空间。在评估被征收土地的市场价值时,可依据市场化程度,选择可比销售法或收益资本法进行评估。
Based on the central government’s policy objective of "not degrading the original life of the land-expropriated farmers and ensuring their long-term livelihood" and the Article 48 of the new "Land Management Law", theoretically exploring market-based compensation standards for land expropriation, is not only beneficial to embody the complete and true value of the expropriated property and protect the property rights of the peasants expropriated land, and is also conducive to achieving a balance between public and private interests.This paper believes that focusing on the highest and best use of the land and emphasizing the equivalence and fairness of compensation, will help the land-expropriated farmers to share the land value-added benefits. The opening of the land-use right trading market and the reform of the compensation system for house expropriation on state-owned land have provided institutional space for fair market value compensation for rural collective land expropriation. When assessing the market value of the expropriated land, the comparable sales method or the income capital method can be selected according to the degree of marketization.
