高等学校信息公开的政府管理职能探析

An Analysis of Government Management Function of Information Disclosure in Colleges and Universities

信息公开已经成为高校办学发展的重要内容,认识政府职能在其中发挥的关键作用是当务之急。在反思高校信息公开的实践中,主要发现了三方面的问题:首先在信息公开的现实问题出现时,立法上无法及时改善,并且在一开始的法律救济制度设计上也留下了隐患;其次,是高校信息公开监管权的实际归属模糊问题以及政府监管范围不明问题;最后,是关于高校信息违法行为的追责治理问题。由此提出政府在高校信息公开的诸多现状问题上的督导作用。政府应加强监管领导意识,继续完善相关的法律法规制度建设;落实主管单位的监管责任,明确监督范围;依法落实责任制度,加强问责效力。

Information disclosure has become an important part of the development of colleges and universities.In the practice of information disclosure in colleges and universities,three problems are mainly found:first,when the real problems of information disclosure appear,colleges and universities have no right to carry out actual improvement in legislation,and also leave hidden dangers in the design of legal relief system at the beginning;Secondly,the actual ownership of the right of supervision over university information disclosure is ambiguous and the scope of government supervision is unclear.Finally,it is to the university information illegal behavior accountability governance problem.In view of this,we discuss the government's supervision role in many current problems of university information disclosure.The government should:Strengthen the sense of supervision leadership and continue to improve relevant laws and regulations;Implement the supervisory responsibility of the competent unit and specify the scope of supervision;Implement the responsibility system in accordance with the law and strengthen the effectiveness of accountability.
