运用SPSS模型检测发现,我国黑社会性质组织犯罪在量刑情节适用上存在涉黑主体差异、地区差异等问题。建立黑社会性质组织犯罪常态化量刑情节适用机制必须从理念层面思考,摒弃从宽情节不适用于重罪犯罪分子以及认罪认罚制度不适用于重罪的偏见,并在实证基础上确立人身危险性的实质认定标准。

The SPSS model reveals that there was some disparate in different regions and different blank subjects in the application of balancing plots in the crime of organizing.So in order to build up a normalizing system,we should rethink deeply about some biased concepts,abandon the prejudice of the subject label in view of lenient plots,the prejudice of the target of confession and punishment,and judging substantially the preventive sentencing plots by the degree of personal danger which is established on the basis of empirical evidence.
