China Needs to Formulate a Unified "Digital Economy Promotion Law"

制定统一的《数字经济促进法》,是我国数字经济多元立法的体系化需要,是全方位深入推进数字产业化和产业数字化的需要,是统筹并理顺中央立法与地方立法关系的需要。从2020年至今,一些省、市分别制定了地方《数字经济促进条例》,这些地方立法虽然普遍重视运用法律手段引导和保障当地数字经济发展,但难以克服自身承载能力有限的固有局限。科学制定统一的《数字经济促进法》,需要重点把握好五个问题,即结构设计与法律责任、概念使用及其解释、重点制度、国际竞争合作以及立法协调。

The formulation of a unified"Digital Economy Promotion Law"is the need for the systematization of China's diversified digital economy legislation,the need to comprehensively and deeply promote digital industrialization and industrial digitization,and the need to coordinate and straighten out the relationship between the central legislation and the local legislation.Since 2020,Zhejiang,Henan,Guangdong,Hebei,Jiangsu and other provinces in China have respectively formulated their local "Regulation on the Promotion of Digital Economy".Although these local legislations generally attach importance to the use of legal means to guide and protect the development of local digital economy,it is difficult to overcome the inherent limitations of their own limited carrying capacity.To scientifically formulate a unified "Digital Economy Promotion Law",it is necessary for us to focus on five issues,namely,the structural design and legal responsibility,concept use and interpretation,key legal systems,international competition and cooperation,and legislative coordination.
