论互联网时代儿童个人信息法律保护的完善

On the Improvement of Legal Protection for Children’s Personal Information in the Internet Era

随着互联网技术的迅速发展和广泛普及,“触网”低龄化趋势明显,儿童成为网络“原住民”。由于身心发育尚不成熟、自我保护能力较弱,儿童在参与网络活动时个人信息极易遭受泄露和滥用。儿童个人信息侵权事件频发,加强儿童个人信息保护迫在眉睫。基于对我国儿童个人信息保护立法现状的分析,当前我国儿童个人信息法律保护存在法律法规体系尚不健全、行政执法监管力度不足、监护人同意机制失效的问题,建议从健全儿童个人信息保护法律法规体系、加强儿童个人信息保护行政执法监管、完善监护人同意制度具体规则设计方面着手进行完善,从而更好地实现对儿童个人信息的全面有效保护。

With the rapid development and popularization of the Internet technology,there is an obvious trend of“accessing the Internet”at a younger age,and children have gradually become the so-called“native residents”of the Internet. Owing to their immature physical and mental development and low self-protection ability,children are vulnerable to the leakage and abuse of their personal information when they participate in online activities. In reality,there are frequent incidents of children’s personal information infringement,so it is imminent to strengthen the protection of children’s personal information. Based on an analysis of the status quo of the children’s personal information protection legislation in our country,there are some problems in the legal protection of children’s personal information,such as the imperfect legal and regulatory system,the insufficient supervision of administrative law enforcement,and the failure of the guardian consent system. It is suggested improving the legal system of children’s personal information protection,strengthening the supervision of children’s personal information protection,and perfecting the design of the specific rules of guardian’s consent system,in order to better achieve the comprehensive and effective protection of children’s personal information.
