摘要
引用标准已成为支撑法律法规有效实施的重要手段。本文梳理了韩国技术法规和工业标准的现状,研究分析了二者的相互关系和技术法规引用标准的模式。在此基础上,深入探讨和分析了韩国技术法规引用标准制度和运作实践,提出了充分发挥社会团体的作用,建立科学的技术法规影响评估制度,建立健全我国法律法规引用标准的制度等对策建议。
Referencing standards has become an important means to support the effective implementation of laws and regulations. This paper studies the current situation of technical regulations and industrial standards in South Korea,analyzes the relationship between technical regulations and industrial standards and the model of standard reference of technical regulations. On this basis, this paper discusses and analyzes South Korea’s system and operation practice for referencing standards in regulations, and puts forward some suggestions for bringing the role of social organizations into full play, establishing a scientific impact assessment system for technical regulations, establishing and improving the system for referencing standards in regulations.
