关于在联合国人权框架下建立《老年人权利公约》的思考

Reflections on Formulating the Convention on the Rights of Older Persons Within the UN Human Rights Framework

老年群体的特殊性与人口老龄化的客观现实,使得老年人权利保护日益受到关注,在联合国人权框架下建立《老年人权利公约》具有必要性和可行性。从国际人权条约、政策性文件、人权机制工作进展现状等角度分析,目前老年人权利保护取得了一定成果,但在规范和实施层面均存在较大问题,效果不佳。因此,应建立统一、综合、有法律约束力的《老年人权利公约》,并配置相应条约机构,加强国际合作。中国在这一过程中应从国际、国内两个层面积极参与。

Special characteristics of older people and the reality of an aging global population have led to increasing attention to protecting the rights of older persons,and therefore formulating the Convention on the Rights of Older Persons within the UN human rights framework is both necessary and feasible.From perspectives of international human rights treaties,policy documents and current progress on UN human rights mechanisms,it is found that certain results have been achieved in protecting the rights of older persons,but major problems at both the normative and implementation levels still exist,which shows insufficient results.In view of this situation,a unified,comprehensive and legally binding Convention on the Rights of Older Persons should be developed and corresponding organs should be established to strengthen international cooperation.China should actively participate in this process from both international and domestic levels.
