中国参与全球数字经济规则制定的有关建议与对策研究

Research on relevant suggestions and countermeasures of China ’s participation in the formulation of global digital economy rules

全球数字治理迎来规则重构关键期,中国应当引领构建全球数字经济规则制定,推动形成数字经济全球治理新机制,为解决“治理赤字”贡献中国智慧、中国方案。中国引领构建全球数字经济规则制定具备良好基础条件,但与“欧洲模板”“美国模板”相比,中国方案竞争优势尤其是国际话语权优势不突出,存在与美国在数据流动规则的博弈中处于劣势、数字税推行缺乏可行性方案、数据隐私保护能力不强等难点、堵点。建议在国内规则层面,加强顶层设计,推进数据流动监管领域各类规则的制定与升级,探索适合中国数字服务税的建设方案;在国际规则层面,依托区域性规则谈判,力争数字贸易、跨境数据流动规则的主导权,加快搭建“国际数字经济特区”等平台,促进规则先行先试。

At present, global digital governance has greeted in a critical period of rule reconstruction. China should lead the formulation of global digital economy rules, promote the formation of a new global governance mechanism for the digital economy, and contribute Chinese wisdom and Chinese solutions to solving the “governance deficit”. China has good basic conditions to lead the formulation of global digital economy rules, but compared with the “European template” and “American template”, the competitive advantage of China ’s plan, especially the advantage of international discourse power, is not prominent, and China ’s plan faces difficulties and blocking points such as the disadvantage of the United States in the game of data flow rules, the lack of a feasible plan for the implementation of digital tax, and the weak data privacy protection ability. It is recommended to strengthen top-level design at the level of domestic rules, promote the formulation and upgrading of various rules in the field of data flow supervision, and explore a construction plan suitable for my country ’s digital service tax;at the level of international rules, relying on regional rules negotiation, striving for the dominance of digital trade and cross-border data flow rules, accelerating the establishment of platforms such as “international digital special economic zones”, and promoting rules to be tested first.
