我国金融数据治理法律构建的三个维度

Three Dimensions of the Construction of Chinese Financial Data Governance Law

数据是发展数字金融的核心要素。在数字经济时代,数据治理能力在一定程度上反映一个国家的金融治理能力和金融核心力,也是一个国家经济核心竞争力的主要因素。当前,我国金融数据治理面临数据权属不明、数据质量不一、数据资产定价方式模糊、数据安全隐患突出等问题的困扰。对此,在安全的前提下,从立法、监管和市场三个维度构建我国金融数据治理的法律框架,实现开放与共享的金融数据治理的法律框架显得尤为重要和迫切:就立法与监管维度而言,政府应大力推进金融数据标准化建设,推动建立金融数据交易机制和共享平台,加快数据权属相关立法以及加大个人信息保护执法力度;就市场维度而言,金融机构应明确责任并制定详实、系统的数据安全管理制度。

Data is the core element for the development of digital finance. In the era of digital economy, data governance capability, to some extent, reflects the financial governance capability and financial core strength a country and is also a major factor of economic core competitiveness. China’s financial data governance at this stage still faces problems such as unclear data ownership, varied data quality, ambiguous pricing methods for data assets, and prominent data security risks. To solve these problems, it is particularly important and urgent to build a legal framework for financial data governance that is open and shared, with the premise of security, from legislation, regulation and market. In terms of legislation and regulation, the government should vigorously promote the standardized construction of financial data, promote the establishment of financial data transaction mechanisms and sharing platforms, speed up legislation on data ownership, and strengthen law enforcement on personal information protection. In terms of the market, financial institutions should clarify their responsibilities and formulate detailed and systematic data security management systems.
