全面促进职业发展:新修订《体育法》中运动员权利保障的立法突破与现实效应

Comprehensive Promotion of Career Development:Legislative Breakthroughs and Practical Significance of Athletes’ Rights Protection in the Newly Revised Sports Law

运动员职业发展权利及其保障作为2022年《体育法》修订的重要内容之一,对加强新时代我国运动员社会保障、促进运动员全面发展意义重大。结合马克思主义关于人的全面发展理论、以人民为中心的发展思想及职业发展理论等,对新修订《体育法》中运动员权利保障部分的内容进行全面梳理与分析。研究认为,新修订《体育法》彰显了以人民为中心的运动员权利保障立法理念,构建了以运动员职业特点为基础的法律权利体系,确立了多部门协同治理的运动员权利保障思路。这就为保障我国运动员的职业发展权利、完善竞技体育后备人才培养体系、助力体育强国建设提供了法律支撑。

As one of the important contents of the revision of the Sports Law in 2022, the right of athletes’ career development and its guarantee are of great significance to strengthen the social security of Chinese athletes and promote their comprehensive development in the new era. Combining the basic theoretical principles of Marxist theory on comprehensive human development, people-centered development thought and career development theory, the paper comprehensively sorts out and analyzes the contents of the part of athletes’ rights protection in the newly revised Sports Law. The new revised Sports Law highlights the people-centered legislation concept of athletes’ rights protection, builds a legal rights system based on the professional characteristics of athletes, and establishes the idea of multi-department cooperative governance for athletes’ rights protection. This provides legal support for protecting the professional development rights of Chinese athletes, improving the training system of competitive sports reserve talents, and helping the construction of a leading sporting nation.
