社会主义核心价值观融入裁判说理:依据、方法与限度

On the Integration of Core Socialist Values into Judgment Reasoning:The Bases,Methods and Limits

最高人民法院印发的《关于深入推进社会主义核心价值观融入裁判文书释法说理的指导意见》,对社会主义核心价值观融入裁判文书释法说理作出了具体要求,着力推动社会主义核心价值观融入法治建设,加强司法裁判文书说理。社会主义核心价值观融入裁判说理在适用依据上有待进一步明确,融入方式应当明确价值观内涵、强调明确法律依据、注重说理逻辑、针对事实争议有效论证,以达到以理释法,以案普理的目的。融入不是代替,在裁判文书说理过程中,社会主义核心价值观的融入有符合自身规律的限度,不能使核心价值观在裁判说理中的适用泛化,“以理代法”。

The Guiding Opinions on Further Promoting the Integration of Core Socialist Values into the Inter⁃pretation and Reasoning of Judgment Documents,issued by the Supreme People’s Court,clearly stipulates that core socialist values are used as the basis for the reasoning of judgment document while clarifying the rules of integrating core socialist values into the interpretation and reasoning of judgment documents,with the focus on an effective merger between the core socialist values and the prevailing laws by strengthening the reasoning of judgment documents.Specifically,to achieve an effective and efficient integration,the implementation bases need to be well defined and confirmed.And the methods employed in the study are advisable to involve a clear understanding of core values,a consensus on the law as judgment basis,a fluent logic during reasoning,and a firm belief in the major facts closely related with the case.Furthermore,the attempts of applying core values to judgment documents should be limited to a rational scope,in case of the replacement of law and abuse in deal⁃ing with the case.
