摘要
国家市场监管总局对阿里巴巴实施“限定交易”进行行政处罚事件是一次标志性事件。对互联网平台经营者滥用市场支配地位的认定应考虑市场份额、市场控制能力、在关联市场中的优势、本身的技术财力、平台内的经营者对其的依赖程度等。在认定滥用市场支配地位时,需要细分隐蔽不公平价格、掠夺市场、数据封锁、限定交易、数据捆绑搭售、基于算法的差别定价等类型。在损害后果认定时,需考虑对平台内经营者、平台所在市场以及消费者的影响。在正当理由认定时,效率、公平和客观必要性需要纳入考虑。基于这些认定标准,文章根据现行反垄断领域立法,对大数据市场滥用市场支配地位从立法、企业和消费者角度提出了相应的解决意见。
The administrative penalty imposed by the State Administration for Market Regulation on Alibaba's implementation of“restricted transactions”is a landmark event.The determination of an Internet platform operator's abuse of a dominant market position should take into account market share,market control capabilities,advantages in the affiliated market,its own technical and financial resources,and the degree of dependence of operators on the platform on it.When identifying abuse of market dominance,it is necessary to subdivide the types of concealed unfair prices,market plunder,data blocking,restricted transactions,data tying,and algorithm-based differential pricing.When determining the consequences of damage,it is necessary to consider the impact on the operators on the platform,the market where the platform is located,and consumers.Efficiency,fairness,and objective necessity need to be taken into account when justifying justification.Based on these identification standards,the article puts forward corresponding solutions from the perspectives of legislation,enterprises and consumers for the abuse of market dominance in the big data market according to the current anti-monopoly legislation.
