短视频使用他人作品是否构成合理使用对保障著作权人的权益和促进短视频行业发展具有重大意义。针对短视频合理使用制度存在的弊端,宜先界定短视频合理使用的类型,再借鉴域外四要素检验法和转换性理论,结合我国短视频行业发展实情,提出短视频创作认定需注重的因素,以此完善我国合理使用制度的不足,为短视频行业发展提供制度保障。

Whether the use of other people’s works in short videos constitutes fair use is of great signifi cance to protecting the rights and interests of copyright owners and promoting the development of the short video industry. In view of the shortcomings of the short video fair use system in my country’s legislation and judiciary, we can first define the types of short video fair use. Then, by referring to the foreign four-factor test method and transformation theory, combined with the actual development of my country’s short video industry, the factors that need to be paid attention to in the identifi cation of short video creation are put forward. Finally, improve the shortcomings of my country’s fair use system and provide institutional guarantees for the development of the short video industry.
