习近平法治思想中传统社会民事纠纷解决方式的现代借鉴

On Civil Dispute Resolutions in Traditional Society and the Time Value in Xi Jinping Thought on the Rule of Law

传承和弘扬中华优秀传统法律文化、探究传统社会民事纠纷解决模式的现代价值是习近平法治思想中的重要内容,也是建设我国法治社会的应有之义。在现代法治背景下,多元纠纷解决机制改革既要在解纷理念上引导当事人多元的选择解纷途径,又要在纠纷解决的具体实践中向历史经验进行学习,一是规范法院委托调解,灵活地将纠纷委托至相应的调解组织;二是完善纠纷解决过程中“横向”与“纵向”的沟通,降低当事人解决纠纷的成本,提高纠纷解决效率。最后,在纠纷解决机制构建中,要充分调动纠纷解决的社会力量,在民间调解组织人员构成中既要涵盖专业知识的“智者”,也要包括社区内具有话语权的“长者”。

Inheriting and carrying forward the excellent traditional Chinese legal culture,and exploring the time value of the modes of resolving the civil disputes in traditional society are an important part of Xi Jinping Thought on the Rule of Law and the due tasks of building a society ruled by law in China,too.In the context of rule of law in modern time,to reform the dispute resolution mechanism,it is necessary to guide the parties involved to choose appropriate ways in thought,and borrow the historical experience in practice as well.Firstly,the court should be regulated and flexible ways can be adopted to entrust the disputes to the corresponding mediation organizations.Secondly,communications should be made to reduce the cost and improve the efficiency of dispute resolution.Finally,in constructing the dispute resolution mechanism,it is necessary to fully mobilize the social authorities,including the wise with professional knowledge in the civil mediation organizations and the elderly with discourse power in communities.
