侵害未成年人强制报告制度问题研究与对策

Research into the Mechanism of Compulsorily Reporting Juvenile Assault and Countermeasures

近年来,侵害未成年人案件高发,实践中由于未成年人身心不成熟,在遭受侵害时往往不敢、不知甚至不愿意对外告诉。侵害未成年人强制报告制度的确立,有利于破解侵害未成年人案件预防难、发现难、取证难的问题。完善侵害未成年人强制报告制度的对策主要有:增强报告主体责任意识、完善配套措施保障、强化司法制度衔接、做好后续跟踪回访工作等。

In recent years,the incidence rate of juvenile assault cases has been increasing.In practice,because juveniles are physically and psychologically immature,they often dare not,do not know or even do not want to tell others when they are sexually assaulted.The establishment of the mechanism of compulsorily reporting juvenile assault is conducive to solving the problems of difficult prevention,difficult discovery and difficult evidence collection.The countermeasures to improve the mechanism of compulsorily reporting juvenile assault mainly include:the reinforcement of the subjects’ consciousness of responsibility for the report,improvement of the supporting measures,enhancement of the alignment with the judicial system,timely follow-up visits,etc.
