改革过渡期国土空间规划地方立法探索——以《宁波市国土空间规划条例》为例

LOCAL LEGISLATION OF TERRITORIAL PLANNING IN THE TRANSITIONAL PERIOD:A CASE STUDY ON REGULATIONS OF NINGBO ON TERRITORIAL PLANNING

在国土空间规划改革过渡期的特殊背景下,以宁波为代表的少数城市开展了地方条例制定工作。国土空间规划地方立法需要回应两大理论命题,一是地方政府有限权力属性下的立法边界问题,二是有效规避立法重复要求下的地方特色问题。基于法律文本分析发现,在把握立法边界方面,宁波通过夯实立法依据、迭代立法框架和细化规划体系,处理好地方事权和中央事权的关系;在体现地方特色方面,宁波通过优化规划许可、强化实施监督和加强设计管控,尽力推进立法创新。宁波市的立法突围路径,为当前探讨国土空间规划地方立法提供了理论和实践样本。

In the special transitional period of territorial planning reform,some cities represented by Ningbo have formulated local regulations.The local legislation of territorial planning needs to respond to two major theoretical propositions:one is the legislative boundary under the limited power of local governments,and the other is the local characteristics under the requirement of avoiding repetitive legislation.The legal text analysis reveals the following findings.In terms of the legislative boundary,Ningbo has well handled the relationship with the higher-level law by consolidating the legislative basis,iterating the legislative framework,and refining the planning system.In terms of local characteristics,Ningbo tries its best to promote legislative innovation by optimizing planning permission,promoting implementation supervision,and strengthening urban design control.The legislation path of Ningbo provides a theoretical and practical sample for exploration on the local legislation of territorial planning.
